1. Introduction
These Terms & Conditions (“Terms”) govern your access to and use of MustChat, including our website https://mustchat.in/, application https://app.mustchat.in/, APIs, dashboards, WhatsApp CRM tools, chatbot builder, automation features, integrations, and related services (“Services”).
For these Terms, “MustChat,” “we,” “us,” or “our” refers to Aasman Digitals, the legal entity operating the platform. “Customer,” “Business,” or “you” refers to any individual or organization using MustChat.
By accessing or using MustChat, you agree to these Terms. If you do not agree, you must not use the Services.
MustChat is not affiliated with WhatsApp, Meta, Facebook, or Instagram. WhatsApp is a trademark of its respective owner.
2. Eligibility
To use MustChat, you must:
- Be at least 18 years old or authorized to act for a business
- Have legal authority to bind your organization
- Comply with all applicable laws and regulations
- Not use the platform for illegal, harmful, or unauthorized purposes
3. Account Registration
To access Services, you may need to create an account. You agree to:
- Provide accurate and complete information
- Maintain confidentiality of login credentials
- Be responsible for all activity under your account
- Notify us immediately of unauthorized access
We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.
4. Description of Services
MustChat provides a SaaS platform that includes:
- WhatsApp CRM and shared inbox
- Chatbot builder
- Broadcast and campaign management
- Automation workflows
- API and webhook integrations
- Customer segmentation and tagging
- Analytics and reporting tools
- Team collaboration tools
Services may evolve, and we may add, modify, or remove features at any time.
5. Use of WhatsApp & Meta Services
MustChat operates as a software layer on top of WhatsApp Business Platform. You acknowledge that:
- WhatsApp/Meta governs message delivery rules
- Message templates require approval
- Accounts may be restricted by WhatsApp/Meta policies
- We are not responsible for WhatsApp downtime or policy enforcement actions
6. Customer Responsibilities
You agree that you will:
- Use MustChat only for lawful business purposes
- Obtain valid consent before messaging customers
- Avoid spam, fraud, or misleading content
- Respect opt-out requests immediately
- Ensure compliance with WhatsApp and data protection laws
- Secure your account, API keys, and integrations
- Maintain your own privacy policy for your customers
You are solely responsible for all messages sent through your account.
7. Prohibited Activities
You may NOT use MustChat for:
- Spam or unsolicited messaging
- Illegal goods or services
- Fraudulent or deceptive practices
- Sending malware or harmful code
- Harassment or abusive communication
- Violation of WhatsApp/Meta policies
- Reverse engineering or unauthorized access
- Reselling or white-labeling without permission
Violation may result in immediate suspension or termination.
8. Payments, Billing & Subscription
- MustChat is a paid SaaS service unless explicitly stated otherwise
- Fees are billed on subscription basis (monthly/annual or custom plans)
- Payments are non-refundable unless stated in refund policy
- Failure to pay may result in suspension or account downgrade
- Taxes (GST or applicable) are the responsibility of the customer
9. Intellectual Property
All rights, title, and interest in MustChat (including software, design, branding, and features) belong to Aasman Digitals.
You may not:
- Copy, modify, or distribute our platform
- Reverse engineer or clone the system
- Use our branding without permission
10. Data Ownership
- You retain ownership of your customer data
- We process data only to provide Services
- We do not sell or rent your customer data
- You are responsible for legality of uploaded data
11. Service Availability
We aim for continuous uptime but do not guarantee:
- Uninterrupted service
- Error-free operation
- Compatibility with all third-party systems
Maintenance, updates, or outages may occur without prior notice.
12. Third-Party Services
MustChat integrates with third-party services such as:
- WhatsApp / Meta
- Payment gateways
- CRMs and automation tools
- Cloud infrastructure providers
We are not responsible for third-party service failures or policies.
13. Termination
We may suspend or terminate access if:
- You violate these Terms
- You engage in abusive or illegal activity
- Required by law or WhatsApp/Meta enforcement
- Payment is not completed
You may stop using MustChat at any time.
14. Limitation of Liability
To the maximum extent permitted by law:
- We are not liable for indirect or consequential damages
- We are not responsible for data loss due to third-party failures
- We are not liable for WhatsApp or Meta account restrictions
- Our total liability is limited to the amount paid in the last subscription cycle
15. Indemnification
You agree to indemnify and hold harmless Aasman Digitals from claims arising from:
- Your misuse of the platform
- Violation of laws or WhatsApp policies
- Disputes with your customers
- Unauthorized messaging or data usage
16. Changes to Terms
We may update these Terms at any time. Continued use of MustChat means acceptance of revised Terms.
17. Governing Law
These Terms are governed by the laws of India. Any disputes shall be subject to the jurisdiction of courts in Haryana, India.
